457 Visa | Employer Transfer

If you are currently on a 457 visa and you wish to change employer sponsors, you can do it. There is actually no need to apply for a 482 TSS visa as long as there is still enough time left on the validity period of your current 457 visa. Your occupation must also still be in the current occupation list.

Now, the key factor is doing it in a timely manner to ensure that your 457 visa does not get cancelled, because there is either a 90-day period or 60-day period (depending on the date of your 457 visa grant) where you have an opportunity to find a new employer. Otherwise, if you go beyond this “grace” period, your 457 visa can be cancelled.

 

Here is how to transfer a 457 visa without risking cancellation:

 

Step 1: Employment Contract Compliance (notice period for termination of employment)

You need to comply with the notice period of your employment contract with your current 457 sponsor (example: 4 weeks notice). Once you and your employer are on the same page with the terms of your resignation, your employer will then notify Immigration that your employment with them has ended.

 

Step 2: 90 Days / 60 Days To Get A New Sponsor

Once you know the date of your final day of employment, you will have exactly 90 days or 60 days to find a new employer to sponsor and nominate you to continue working in Australia on a 457 visa. If your 457 visa was granted before the 19th of November 2016, you will have 90 days to transfer your 457 visa. If your 457 visa was granted on the 19th of November 2016 and onwards, you will have 60 days.

 

Step 3: Submit New Sponsorship

Your new employer is required to already have an existing (and valid) approved 457 Business Sponsorship or 482 Business Sponsorship. Otherwise, they will be required to lodge a sponsorship application under the new 482 TSS visa program.

 

Step 4: Submit New Nomination

Once a 482 Business Sponsorship has been lodged, a new 482 Nomination must also be submitted which is an application to have the vacant position approved to be filled by an existing 457 visa holder. Both the sponsorship and nomination must be submitted within the 90 / 60 day period. Make sure you mark your calendars and plan your transfer carefully to avoid going over the 90 / 60 day period.

 

Once both the Sponsorship and Nomination have been approved, your 457 visa will continue under your new employer’s business, and they will take over the employer obligations for your time in Australia.

Please note that failure to look for a new employer within 90 / 60 days can result in a possible cancellation of your 457 visa. If you are outside of this period already, then you will definitely need to seek some professional advice to help with your situation.

    Hi, my 457 visa ends on 30th September 2020. I have a bridging visa A waiting not active. I am leaving my current employer. If I am to find a new employer and it falls within 90 days of my 457 visa ending does the new employer still need to sponsor me? As by the time the nomination would go through my 457 visa would have expired. I have full working rights on my BVA.
    Any information would be a huge help.

    I am currently serving the 60 days’ period (after end of current employment) and looking for and sponsorship transfer for my current valid 457 visa (valid for another 2 years). What if I get spencer towards the end of 60 days’ period? Will I get bridging visa to continue to stay in Australia till decision made on sponsorship transfer? Or I will still have to leave Australia and come back only after approval of sponsorship transfer.

    I am a 457 visa holder and yesterday was my last day with my employer/sponsor. This means, I am now in 60 days period (visa validity post employment) and looking for a new employer to sponsor.

    I am going through lot of confusion during this phase and look to get them cleared.

    1. Do I need to let DIBP know about my end of employment? or its something my employer has to take care of?
    2. During this 60 days period, can I travel from Australia and come back?
    3. I am already in discussion with one of the employer who is willing to sponsor. After looking at my occupation, they are confident that they can request to transfer the sponsorship. They may file the transfer request soon, while they are doing this or once they submit request, can I travel from Australia and come back? I am not sure when will actually transfer request will complete.
    4. On other note, my husband holds his own primary 482 visa and his employer is going to request 482 dependent visa for me. Both this requests may go in parallel, do you see any issue in this regards? at the end which visa will be valid for me?

    Hi Team,

    I hold 457 Visa granted on 17 May 2018 and started to work for the company on 18 August 2017. Now they are not willing to sponsor me for my PR on Direct stream 186 as there is a levy to pay which is additional expense. i need to transfer to another employer even in another state such as NT or Tasmania, is it possible to do that? Or can i hold a dependent visa which my wife will be the main applicant, will that lead to cancellation of the 457?

    Hi i was in 457 visa for 3 years for company 1 and now i quit the company for some reason . So my option is to find company b to nomination trasfer of my 457 but i ask agents they were saying i cannot nomination trasfer 457 to 457 but i have to apply new tss visa . And i have 90 days to trasfer this all .. so if i do this new tss visa things its does take time no . So my question is can i do 457 nomination trasfer straight or i have to go tas visa first … confused?

    I have been made redundant last December 5, 2018 and got an offer from other company.     I transferred to a new employer, I had 457 visa and they did nomination for 482. It has been approved, but on the approval it says that the nominee now can submit the visa application. But I thought that for sponsor transfer, I don’t have to apply again? And I haven’t received any notice from immigration saying that I now have a new sponsor nor does it say on my immi account, it’s still old information there.

    Hi! I”m on the 457 (granted in May 2016) but my employer forced me to resign on October 2018. However I applied for my residency with my partner in March 2018 (as a dependent of his visa 189 New Zealand stream) and it seems like it’ll only get approved in May 2019. What happens if my 457 is canceled after the 90 day period? Will I go straight to the Bridging Visa A? Should I leave the country and wait for the residency there? Will immigration contact me after the 90 day period? Many thanks

    Hi, im currently on 457 with 4 years validity. I have resigned from my previous employer and looking tomtransfer another employer for sponsorship. I have been told to apply a new visa under TSS as my current visa has a different nomination code. I was initially sponsored as a RN in Aged Care now intending to work as a RN in hospital which means different nimonatiin code. Unsire if this is correct as inwas advises that reapplying a new visa is not necessry

    I am on 457 visa expiring in Jun 2019 and have lodged 189 visa application in Dec 2017. I received Bridging visa A but not in effect yet.
    Meanwhile, I am planning to change employer but my new employer is offering a job based on my working rights (not sponsoring).

        What is the meaning of nomination.? My son has applied for 457 visa last March and now on bridging visa A .once he get the 457 visa and then apply spouse visa and left the job and moved to another state ,under which visa he will be and can he ask for work rights?
        Also before leaving the current sponsor if he find another sponsor how long it will take to transfer the sponsor at immigration?
