If you are currently on a 457 visa and you wish to change employer sponsors, you can do it. There is actually no need to apply for a 482 TSS visa as long as there is still enough time left on the validity period of your current 457 visa. Your occupation must also still be in the current occupation list.

Now, the key factor is doing it in a timely manner to ensure that your 457 visa does not get cancelled, because there is either a 90-day period or 60-day period (depending on the date of your 457 visa grant) where you have an opportunity to find a new employer. Otherwise, if you go beyond this “grace” period, your 457 visa can be cancelled.

Here is how to transfer a 457 visa without risking cancellation:

Step 1: Employment Contract Compliance (notice period for termination of employment)

You need to comply with the notice period of your employment contract with your current 457 sponsor (example: 4 weeks notice). Once you and your employer are on the same page with the terms of your resignation, your employer will then notify Immigration that your employment with them has ended.

Step 2: 90 Days / 60 Days To Get A New Sponsor

Once you know the date of your final day of employment, you will have exactly 90 days or 60 days to find a new employer to sponsor and nominate you to continue working in Australia on a 457 visa. If your 457 visa was granted before the 19th of November 2016, you will have 90 days to transfer your 457 visa. If your 457 visa was granted on the 19th of November 2016 and onwards, you will have 60 days.

Step 3: Submit New Sponsorship

Your new employer is required to already have an existing (and valid) approved 457 Business Sponsorship or 482 Business Sponsorship. Otherwise, they will be required to lodge a sponsorship application under the new 482 TSS visa program.

Step 4: Submit New Nomination

Once a 482 Business Sponsorship has been lodged, a new 482 Nomination must also be submitted which is an application to have the vacant position approved to be filled by an existing 457 visa holder. Both the sponsorship and nomination must be submitted within the 90 / 60 day period. Make sure you mark your calendars and plan your transfer carefully to avoid going over the 90 / 60 day period.

Once both the Sponsorship and Nomination have been approved, your 457 visa will continue under your new employer’s business, and they will take over the employer obligations for your time in Australia.

Please note that failure to look for a new employer within 90 / 60 days can result in a possible cancellation of your 457 visa. If you are outside of this period already, then you will definitely need to seek some professional advice to help with your situation.

What is a Partner Visa?

Basically, a Partner Visa enables the partner of an Australian citizen or permanent resident to stay in Australia. There are two categories: Prospective Marriage visa and Partner Visa. These categories differ based on the type of relationship you are in. A Prospective Marriage visa applies to couples intending to get married while the Partner Visa applies to married couples or those in a de facto relationship.

A Partner Visa involves two stages. The first stage entitles you to a Temporary Partner (subclass 820 or 309) visa which allows you to live in Australia. Once you reach two years under the Temporary Partner Visa, you may be eligible to apply for the second stage which is the Permanent Partner Visa (subclass 801 or 100) stage which grants you permanent residency status.

Eligibility Criteria

An applicant for the Prospective Marriage (300) visa must have met, known and intend to marry their prospective spouse. The applicant must also be at least 18 years of age.

An applicant for the Partner Visa must either be married or in a de-facto relationship with an Australian citizen or permanent resident. The marriage must be valid under Australian law. If in a de-facto relationship, the relationship must be proven to be at least 12 months. However, the 12-month requirement may be waived in certain circumstances. For more details, click here.

The Temporary Skill Shortage (TSS) visa (subclass 482) has been implemented last 18 March 2018 as a replacement for the 457 Visa. This visa has 2 streams: the short-term stream with a maximum employment of 2 years and the medium-term stream with a maximum employment of 4 years. The new Temporary Skill Shortage (TSS) visa will be implemented this coming March 2018. In line with this, the Department of Home Affairs has released the rules and changes that will apply to lodged 457 applications prior to the implementation date of the 457 visa and valid 457 sponsorships, nomination and visa applications.

LODGED APPLICATIONS

If you have lodged a Standard Business Sponsorship (SBS) before the TSS Visa implementation date, the application will still be processed under the old rules. The only changes will be that employers are able to renew their sponsorship which will then be valid for 5 years. The new training benchmarks will also not apply.

If you have lodged an application for a Subclass 457 nomination for existing 457 visa holders before the implementation date, the application will be processed under the old rules.

If you have lodged an application for a Subclass 457 visa nomination and a related visa application before the implementation date, the application will be processed under the old rules.

If you have lodged an application for a Subclass 457 visa nomination without a related visa application before the application date, the application will be deemed invalid. The nomination fee will be automatically refunded to the nominee.

If you have lodged an application for a Subclass 457 visa application before the implementation date, the application will be processed under the old rules. Should the 457 requirements be satisfied, the applicant will be granted a 457 visa.

EXISTING AND VALID APPROVALS

If you have an existing SBS sponsorship, you are eligible to nominate an overseas worker under the new TSS visa program. This may include existing 457 visa holders. A new nomination will be required should there be a change of employer or occupation. You are also eligible to apply for a sponsorship renewal before the expiry date.

If you have an approved & valid 457 visa nomination, you are not eligible to lodge a TSS visa application until you lodge a new TSS visa nomination.

The Australian Government will be introducing the Temporary Skill Shortage (TSS) visa on March 2018. The purpose for this visa to make sure that business have access to critical skills needed for growth should no Australian worker be available. There are 3 streams for the TSS visa:

1. Short-term stream

The short-term stream allows employers to sponsor temporary overseas skilled workers whose occupations are under the Short-term Skilled Occupation List (STSOL). The maximum employment period is 2 years. If an international trade obligation applies, the maximum employment period is 4 years.

2. Medium-term stream

The medium-term stream allows employers to sponsor highly skilled overseas workers whose occupations are under the Medium and Long Term Strategic Skills List (MLTSSL). The maximum employment period is 4 years. A TSS visa holder may be eligible to apply for permanent residency after 3 years.

3. Labour agreement stream

The labour agreement stream allows employers to sponsor skilled overseas workers in accordance with a labour agreement with the Commonwealth. This will be based on a demonstrated need that cannot be met in the Australian labour market and the unavailability of a standard visa program. The maximum employment period is 4 years. Applicants have the opportunity to apply for permanent residency.

The changes listed below will only affect applications submitted and invitations issued from 17 January 2018 onwards.
