Question: How soon can I apply for PR (permanent residency) after the grant of my 457 visa?

This is one of the top questions that me and my team get asked after helping people acquire a 457 (employer sponsored working visa).

Most people actually think that you "must" wait for 2 years on a 457 working with the same employer before you can apply for your PR. But this is actually not true.

A 457 visa allows you to work in Australia with your sponsoring employer. If you have worked for your sponsoring employer for 2 years, you can apply for Permanent Residency via the subclasses 186 or 187 with the same employer sponsor, with some concessions in the requirements for the 186 or 187 (via the Temporary Transitional stream). This includes not having to do a Skills Assessment (therefore not needing to have formal qualifications) andΒ only providing IELTS scores of 5's (minimum).

So what if you have been working for your sponsoring employer for less than 2 years? Or in some cases, not worked at all? Well, you can still apply for Permanent Residency depending on your situation.

If you are applying for the Subclass 186, you can apply for Permanent Residency straight away (through the Direct Entry stream) if you have a positive Skills Assessment, IELTS scores of 6's (minimum) and 3 years of post-qualification employment experience (after your qualification; in the same occupation as your qualification).

If you are applying for the Subclass 187, you can apply for Permanent Residency straight away (also through the Direct Entry stream) if you have IELTS scores of 6's (minimum) and the relevant qualification that is relevant to your occupation. There are some occupations in this subclass that do require a Skills Assessment, but the majority do not.

So the lesson here is do not believe rumours.

    I'm JC, is it true that after getting a permanent residency every sponsored employee needed to stay for another 2years from their employer?
    What if i just got my permanent residency few months ago and i want to resign from my work? The reason is i work 60hours per week and had no overtime pay, even sometimes more than that. And i am not happy at all.
    Do they have rights to apply and cancel my sponsored visa?

  7. Hi, my 457 visa was granted in July 2015. but the new rules to apply for PR requires an english test 6 and when I got my 457 the score required was 5. I am struggling to score 6 in all skills areas, already did the PTE and IELTS 3 times and in all of them I failed in one skill only. I would like to know if I really need to do another english test, as my visa was granted in 2015 and the english required was 5. The only thing that is holding the application is the english test. Also today I saw that the English rules for citizenship changed back to 5. So, why do I need score 6 for PR if when I got the 457 more than 2 years ago it was 5 and now even the citizenship is 5 again. Can i apply pr with my 5 yrs of english medium study in university studies before or not .. thanks

    My husband is working as a Pastry Cook and has his 457 granted last August 2016 (means he has already been working for the company more than 1 year). As per new law rules changed, it is said that our case will not be effected as the visa was granted before 18 April 2017. My husband has actually got his Ielts passed for 6 points overall (6 for each components) and we are waiting to get our PR lodged this coming August 2018. My question is: Is it correct that we are still qualified even though Cook is in the Removed Occupation List after March 2018? Also, is it only 2 years for the eligible working period under 457 instead of 3 years to be able to get the sponsorship from the company and government? Cheers.

  20. Hi, I am holding 457 visa under the meat industry labour agreement. I got this visa on 27 Nov 2014. From 10 Feb 2015 to 3 Jun 2015, I worked for the first employer. And then, I am working for my current employer from 20 Sep 2015. According to the meat industry labour agreement, I can apply for 186 visa after working as skilled meat worker in the same position for 3 years and six months.     My questions are:
    1. Is the working time for 186 visa application calculated from the date I arrived in Australia or the number of days I got pay from the employers?
    2. If it's calculated the number of days I got pay, I can apply for 186 visa on 27 Nov 2018. However, my visa will be expired after 27 Nov 2018. Are there any solutions for me to get the 186 visa with less cost? One of my friends said that you can apply a new 457 visa before it expired or bridging visa E with working permission. I don't think my employer can give me nomination exactly on 27 Nov 2018. It probably after several weeks. Is the bridging visa E good for me, because applying new 457 visas for my family cost too much?

    My question is whether i can still apply for a Permanent Residency after completing 2 years with this same company which will complete in March 2019, or has all the new rules changed that fact? I know I can apply before the 2 years, but in my case i can't, cause i need a skills assesment, which I cant get, since i do not have any payslips for the last 3 years, working within the nominated job.

  40. Hi, I just received a 3 year fellowship to work at UQ as a level B researcher. I have lodged my 457 visa application and I am applying for another fellowship that requires PR status for the applicants. I did my masters dissertation at Uni of South Australia (16 months) and got my PhD from the University of Adelaide (3 years).     I have the case of a friend who is under a 457 and is soon to reach his 2 years contract done and can apply for his PR.
    Unfortunately while those 2 years, he was off work because of a back surgery over than 4 months.
    Will he get ask of doing another 4 month or will he not be eligible to apply for his PR as then his sponsorship will arrive to an end.

    I got granted PR through RSMS 187 on 7th of March. My contract says 2 years after visa granted.
    I just want to confirm with you... Do I finish the 7th of March with them? Do I have to give them 2 weeks notice or not? Do they actually know when did I get my visa granted??? Because I started working with them when I applied for the visa on Dec the year before.

After 7 months I came back to Australia for exactly the same occupation and working for another company with 457 visa (exactly the same conditions). So since from the beginning, I worked for the same occupation more than 24 months (28 months) with two different sponsors, would I be able to get PR under these conditions? Thanks

    I have a problem with employing My employee and need your advice what He can do to keep his visa. He has recently granted his RSMS but not started work yet.

    It's unfortante but I can't afford to employ another staff at this diffcult time however I do not want His visa to be affected.

    Can he relocate and work for any other company in the same regional area he is sponsored from until he get his citizenship.

      Unfortunately we cannot advise you on your situation because you are not a genuine 457 visa applicant.

      You cannot apply for a 457 visa if you do not actually have a job (but all the paperwork is provided to mislead the Department of Immigration). This is against the law and is considered fraud.

      We are a very strict agency and only assist genuine visa applicants, and genuine sponsors (both businesses and Australian individuals).

      We cannot assist you further.

    I've been on a 457 visa since the past 3yrs and 4months.
    My employer is highly willing to sponsor me for the PR 186 Temporaru Resident Transition stream and we are starting to plan/apply soon.

    However, I have a very peculiar situation. Please allow me to explain.

    I worked from my employers office in Sydney for the first 1yr 9months from the time I got the 457.
    After that, due to the nature of work (offshore team in India) & family commitments in India, I've been working FULLTIME remotely from India for 2 months and then 1 month from employers office in Sydney. Ive been travelling back and forth like this for the last 1yr and 8months.
    I've flown in and out of the country 9 times in the last 3yrs 4months due to this work arrangement

    In all, out of the 39 months that I've had the 457, I've lived and worked
    - 23 months from Sydney
    - 16 months from India

    For all the 39 months, I've been a FULL TIME Employee on Payroll receiving my 457 Salary in my AU account. I've also maintained the mandatory Private Health insurances as required by the 457 visa. As such, to the best of our knowledge, neither my employer nor me have failed any obligations that the 457 visa imposes.

    My question is : Does my situation qualify me for the "Worked for 2 years for the sponsoring employer " clause for the 186 ENS or do you see any concerns that the DIAC might raise with my frequent trips in and out of the country ?
